Terms of Service

These Terms are a legally binding contract. If you do not agree, do not create an account, do not pay, and do not use HyperVertual.

1. The service

HyperVertual is a digital software-as-a-service product. We provide an online writing workspace, grammar and style suggestions, document storage, analytics, and an exam-writing coach. There is no physical product and no shipping. Access is delivered immediately to your account over the internet.

We are not a school, university, examiner, or government body. Exam scores and AI feedback are practice tools only. They do not guarantee CSS, PMS, IELTS or any other result.

2. Who may use the service

• You must be at least 18 years old, or the age of majority in your country.
• You must provide accurate registration information and keep it current.
• One human, one account. Sharing logins, reselling access, or creating accounts to evade a ban is a material breach.
• If you use HyperVertual for an organisation, you confirm you have authority to bind that organisation.

3. Plans, prices and auto-renewal

Free access is limited. Paid plans (Pro and Team) are recurring subscriptions billed in US dollars in advance. Prices shown on https://hypervertual.com/#pricing exclude any taxes we are required to collect. By starting a paid plan you authorise us and our payment processor (Stripe) to charge the payment method you provide at signup and on each renewal until you cancel.

Subscriptions renew automatically at the then-current price unless you cancel before the renewal date. We will charge the same interval (monthly unless you select another interval offered at checkout). Failed payments may result in immediate suspension.

4. Cancellation

You may cancel at any time from Billing in your account or by emailing info@hypervertual.com from the registered address. Cancellation stops future renewals. You keep access until the end of the paid period. Cancellation is not a refund. See the Refund & Cancellation Policy.

5. Acceptable use

You must follow the Acceptable Use Policy. You must not use HyperVertual to cheat on live exams, generate illegal content, attack our systems, or infringe others' rights. We may suspend or terminate accounts immediately for breach, fraud, chargebacks, or risk to the service.

6. AI output — no warranty

Suggestions, rewrites and exam scores may be wrong, biased, incomplete or unsuitable. You are solely responsible for reviewing output before you submit, publish or rely on it. HyperVertual is provided “as is” and “as available”. We do not warrant uninterrupted uptime, error-free AI, or fitness for a particular exam or job.

7. Your content

You retain ownership of text you type. You grant HyperVertual a worldwide licence to host, process, transmit and display that content only to operate the service for you. We do not sell your documents. You must have the rights to content you upload.

8. Our intellectual property

The HyperVertual software, name, design, models configuration and documentation are owned by HyperVertual or its licensors. You receive a limited, revocable, non-exclusive, non-transferable licence to use the service during a valid subscription. You may not copy, scrape, reverse engineer, or build a competing product from our service.

9. Payment processor

Card payments are processed by Stripe. We never store full card numbers. Stripe's terms also apply to the payment transaction. Disputing a legitimate charge without first contacting us is a breach of these Terms.

10. Suspension and termination

We may suspend or delete an account for non-payment, abuse, legal risk, or prolonged inactivity. On termination, your licence ends. We may delete documents after a reasonable retention period unless law requires otherwise.

11. Limitation of liability

To the maximum extent permitted by law, HyperVertual is not liable for indirect, incidental, special, consequential or exam-result damages, or for lost profits, data or opportunity. Our total liability for any claim relating to the service is limited to the amount you paid us in the 3 months before the claim. Some jurisdictions do not allow certain limits; in that case they apply to the fullest extent allowed.

12. Indemnity

You will indemnify HyperVertual against claims arising from your content, your misuse of the service, or your violation of law or these Terms.

13. Changes

We may update these Terms. Material changes will be posted on this page with a new effective date. Continued use after the effective date is acceptance. If you do not agree, you must cancel and stop using the service.

14. Governing law

These Terms are governed by the laws applicable to HyperVertual's place of establishment, without regard to conflict-of-law rules. Courts of that place have exclusive jurisdiction, except where consumer law gives you a mandatory local forum.
